Responsible Attorney
Keith H.S. Peck, Esq.
Keith H.S. Peck, Esq. is the attorney responsible for the content of this website and the founder and principal of LegalAction, A Law Corporation. Mr. Peck is licensed to practice law in the State of Hawaii and in multiple federal courts. He has 27 years of experience representing parents of children with disabilities in IDEA and Section 504 proceedings.
Mr. Peck’s practice is limited to the State of Hawaii and the federal courts in which he is admitted. He does not practice law in any other state. Mr. Peck resides in California but is not licensed to practice law in California and does not practice law in California in any capacity.
For matters in other jurisdictions, this website connects families with independent, locally licensed attorneys or law firms who serve as lead counsel and attorney of record in those jurisdictions. Those attorneys practice independently and are solely responsible for the practice of law in their respective jurisdictions. Mr. Peck may consult or assist on IDEA-specific matters as permitted under applicable rules, but he does not supervise, control, or direct the independent attorneys in other jurisdictions, and no attorney-client relationship with Mr. Peck or LegalAction, A Law Corporation is created through those referrals or consultations.

General Information — Educational Purposes Only
The information on this website — including all text, pages, blog posts, guides, FAQs, and content provided by Jin — is provided for general educational purposes only and does not constitute legal advice. Every case is different. Nothing on this website should be relied upon as a substitute for consultation with a qualified attorney about your specific situation.
By accessing or using this website, you acknowledge that all content is provided for general educational purposes only and does not constitute legal advice. No attorney-client relationship is created by viewing, reading, or relying on any content on this website, including content generated by Jin.
LegalAction does not warrant that the information contained on this website is accurate, complete, or current. LegalAction hereby disclaims any and all liability to any person for any loss or damage caused by errors or omissions, whether such errors or omissions result from negligence, accident, or any other cause. Any reference, description, or summary of legal matters or outcomes should not be considered an indication or prediction of results in any other matter, as each case has its own unique facts and applicable law.
Attorney-Client Relationship
Contacting us through this website — including uploading documents, submitting forms, calling our office, or communicating through any feature on this site — does not automatically create an attorney-client relationship with LegalAction, A Law Corporation, Keith H.S. Peck, or any of-counsel or co-counsel attorney. An attorney-client relationship is established only through a signed retainer agreement.
Past Results Do Not Guarantee Future Outcomes
Case results described on this website are summaries of past cases and do not guarantee future results. Each case is unique and must be evaluated on its own merits. The outcome of any particular case depends on the specific facts, applicable law, and circumstances involved. Some cases listed involved multiple attorneys, and the role of each attorney varied by case as described in each case summary.
Attorney Advertising
This website may constitute attorney advertising in some jurisdictions. Prior results do not guarantee a similar outcome. The information presented on this website is not intended as a solicitation in any jurisdiction where LegalAction, A Law Corporation, or its attorneys are not authorized to practice or where such solicitation would be prohibited.
This website is not a solicitation for legal services in California. LegalAction, A Law Corporation does not advertise for California cases and does not accept California cases. Nothing on this website should be construed as an offer to provide legal services to California residents through LegalAction, A Law Corporation.

Multi-Jurisdiction Practice
Services Across Jurisdictions
This website serves families in Hawaii and connects families in other jurisdictions with independent attorneys licensed in those states. In jurisdictions other than Hawaii, legal services are provided exclusively by independent, locally licensed attorneys or law firms who serve as lead counsel and attorney of record. LegalAction, A Law Corporation and Keith H.S. Peck do not practice law in those jurisdictions. The availability of services varies by location. Not all services described on this website are available in every jurisdiction.
Federal Law, State Implementation
Laws governing special education — including the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act — are federal statutes, but their implementation varies by state and local jurisdiction. Information on state-specific or city-specific pages reflects that jurisdiction’s procedures, hearing systems, and administrative framework, and should not be applied to other jurisdictions. Terms such as “due process hearing,” “impartial hearing,” “IHO,” “ALJ,” and “CSE” may have different meanings depending on the jurisdiction.
Fee-Shifting and Attorney Fees
IDEA includes a fee-shifting provision (20 U.S.C. § 1415(i)(3)) that allows prevailing parents to recover reasonable attorney fees from the school district. The availability, procedures, and outcomes of fee-shifting vary by jurisdiction, by the facts of each case, and by the discretion of the adjudicator. Fee-shifting is not guaranteed in any case. Information about attorney fees on state-specific pages reflects general practices in that jurisdiction and should not be assumed to apply elsewhere.
Confidentiality
Confidential Communications
Communications with our office — whether by phone, email, document upload, or through features on this site — are treated as confidential. However, sending us information does not automatically make the communication privileged under attorney-client privilege. Attorney-client privilege attaches only after an attorney-client relationship has been established through a signed retainer agreement.
Prospective Client Information
If you contact us for a consultation but do not engage our services, we will treat the information you share as confidential to the extent permitted by applicable rules of professional conduct. We will not disclose your information to third parties, and all documents and records will be securely deleted after the consultation is complete, unless you direct otherwise.
Conflict Checking
Before establishing an attorney-client relationship, we conduct a conflict check to confirm that representing you does not create a conflict of interest with any existing or former client. If a conflict is identified, we will notify you promptly and, if we are unable to represent you, your information will remain confidential and will be securely deleted.
Privacy & Document Security
Document Security
All documents uploaded through this site are encrypted in transit (TLS) and encrypted at rest. We use industry-standard security measures to protect your information. Access to uploaded documents is restricted to authorized members of our legal team.
Child Privacy
Our upload form asks only for your child’s initials — not their full name. However, the IEP and other documents you upload may contain your child’s full name and other identifying information. All uploaded documents are treated as confidential and handled only by our legal team. We do not share your child’s information with third parties.
By submitting an IEP or any document containing information about your child, you represent that you are the parent or legal guardian of the child identified in those documents and that you have the authority to share that information with our office.
Document Retention
If no attorney-client relationship is established, your documents are deleted after the evaluation is complete. If a formal engagement is established, documents are retained in accordance with our professional obligations and applicable retention requirements in the relevant jurisdiction. You may request deletion of your documents at any time by contacting our office.
Cookies and Tracking Technologies
This website may use cookies and similar tracking technologies for analytics, session management, and to improve user experience. Cookies are small text files stored in your browser that help us understand how visitors use our website. No personally identifiable information is stored within these cookies — only general browser and session information.
We do not use cookies to serve third-party advertising, and we do not sell your browsing data to any third party. Data Sharing with Service Providers and Co-Counsel
In order to provide legal services and to operate this platform, LegalAction may share your personal information with third-party service providers under confidentiality agreements, and with independent of-counsel attorneys for the purpose of evaluating or handling your matter. These parties are required to maintain the confidentiality of your information and to use it only for the purposes for which it has been shared.
LegalAction may also release information about you if required or authorized by law, including in connection with a subpoena, court order, or regulatory inquiry, or to protect against fraud.
AI Disclosure
Jin Is AI — For Educational Purposes Only
Jin is an artificial intelligence assistant designed to provide general educational information about special education law, IDEA, and Section 504. Jin is not an attorney and does not provide legal advice. Interactions with Jin do not create an attorney-client relationship. Jin’s responses are not tailored to any specific jurisdiction and should not be relied upon as a substitute for consultation with a licensed attorney in your state. All information provided by Jin is for general educational purposes only. Always consult with a qualified attorney before making legal decisions about your child’s education.
Jin is an AI avatar. She is not a human being.
Jin’s Limitations
Jin is a powerful tool but she is not perfect. Jin may make mistakes, misinterpret documents, or provide information that is incomplete, outdated, or not applicable to your specific situation. Jin’s responses are generated by artificial intelligence and have not been verified by an attorney before being delivered to you.
Jin’s IEP analysis and intake summaries are preliminary only. They are prepared to assist attorney review — not to replace it. When a family requests a consultation, Keith H.S. Peck reviews the IEP analysis and all information Jin collected prior to that consultation.
If Jin tells you something that does not sound right, trust your instincts — and call us.
Jin and Jurisdiction-Specific Information
Jin may reference general principles of IDEA and Section 504 that apply nationally. However, specific procedures, timelines, hearing systems, and administrative requirements vary by state and locality. Any information provided by Jin about a specific jurisdiction’s procedures should be verified with a licensed attorney in that jurisdiction before being acted upon.
