Special Education Help on the Big Island — Your Child’s Rights Are the Same Statewide
If you are on the Big Island and your child is not receiving the special education services they are entitled to under federal law, you have the same rights as every family in Hawaii — and the same access to experienced legal support. We have been honored to serve Big Island families for many years.
How We Work With Big Island Families
Consultations happen by phone or video — you do not need to travel to get started. We travel to the Big Island for hearings and in-person meetings when needed. Distance has never been a reason for a Hawaii family to go without representation, and it will not be for yours.
What Big Island Families Often Ask Us About
Big Island families reach out to us from Hilo, Kona, and everywhere in between. One of the most common questions we hear is whether distance within the island affects what the DOE is required to provide. Your child’s rights under IDEA do not depend on which side of the island you live on. If you have concerns about your child’s services or placement, we are here to help you understand your options.
Your Rights Under IDEA on the Big Island
Federal law applies equally on every island in Hawaii. Your child is entitled to:
- A free appropriate public education designed for their individual needs.
- An IEP developed with your meaningful participation as an equal member of the team.
- Related services — speech therapy, occupational therapy, counseling, transportation — when needed.
- Placement in the least restrictive environment appropriate to your child’s needs.
- Due process rights if any of the above are not provided.
Attorney Fees
Under IDEA’s fee-shifting provision, if we prevail in your case the Hawaii DOE pays our attorney fees. No retainer. No hourly bills for our legal work. The consultation is always free.
